Effective Date
These Terms & Conditions apply to all bookings made with Mnyalu Safaris from the date of acceptance of a proposal, invoice, or booking confirmation.
1. Contract Formation
Your contract with Mnyalu Safaris is formed when:
- you accept a written proposal or itinerary; and
- you make any payment toward the booking; and
- we issue written booking confirmation.
All three elements are required for a confirmed booking.
2. Prices, Currency, and Validity
- Unless stated otherwise, prices are in USD per person.
- Prices are based on rates, taxes, park fees, and supplier charges available on the proposal issue date.
- A proposal is valid only until its stated expiry date/time.
- After expiry, we may reprice and reissue the itinerary based on current availability and supplier rates.
3. Payment Terms
- Standard deposit: 30% of total booking value, non-refundable once the booking is confirmed in writing.
- Standard balance due: 45 days before the safari arrival date.
- Some services require 100% prepayment on confirmation (for example selected lodges, flights, balloon safari, permits, or charters). These items will be identified in the proposal, invoice, or booking confirmation.
- If payment is late, we may suspend or cancel services and apply cancellation charges.
4. Cancellation by Customer
Cancellation requests must be made in writing by the lead traveler. A cancellation becomes effective only when received by Mnyalu Safaris in writing at its stated contact email, using East Africa Time (EAT) as the reference time.
4.1 Standard Cancellation Charges
The following charges apply to the total booking value unless stricter supplier terms apply:
| Time Before Departure | Cancellation Charge |
|---|---|
| 61+ days | 30% (deposit retained) |
| 60-46 days | 50% |
| 45-31 days | 75% |
| 30-0 days, no-show, or early departure | 100% |
4.2 Non-Refundable Services
Services identified as non-refundable in your proposal or invoice remain non-refundable once confirmed with the supplier, even if your cancellation falls in an earlier cancellation window.
4.3 Refund Scope
Our first option, where operationally possible, is to move the booking to new travel dates rather than cancel it for cash.
Any refund, if exceptionally available or required by applicable law, is limited to amounts actually recovered from suppliers, less non-recoverable costs reasonably incurred by Mnyalu Safaris, including bank charges, card charges, transfer fees, and currency-conversion losses.
No refund is payable for unused services after the safari has started, including unused accommodation, transport, meals, park entry, activities, or early departure by the traveler.
5. Amendments and Date Changes
Requests to amend dates, routing, accommodation level, traveler count, or activities must be made in writing.
If we can accept the request, you are responsible for:
- supplier amendment, reissue, and cancellation fees;
- fare/rate/tax/park-fee differences;
- reasonable administrative costs for implementing the amendment.
Amendments are valid only when confirmed by us in writing.
Where a postponement is requested 61 or more days before the original arrival date, Mnyalu Safaris may, at its discretion, allow one postponement and apply sums already paid toward revised travel dates within 12 months of the original arrival date, subject to supplier approval, availability, revised pricing, and any applicable amendment costs.
Requests received 60 days or less before the original arrival date may be treated as cancellation requests and the cancellation charges in Section 4 will apply.
6. Changes by Mnyalu Safaris
We may make reasonable changes to accommodations, routing, transport, park order, and timing where required by operations, safety, weather, road conditions, supplier availability, or government directives.
Reasonable changes do not create a right to full refund where the main travel purpose remains deliverable.
7. Wildlife and Nature Disclaimer
Safari is a nature-based experience. Wildlife movements, migration timing, weather, and road access are dynamic.
Specific sightings, exact crossing events, and animal behavior cannot be guaranteed and are not grounds for compensation.
8. Force Majeure
We are not liable for delay, disruption, or cancellation caused by events beyond reasonable control, including severe weather, flood, fire, epidemic/pandemic restrictions, airline disruption, civil unrest, border measures, government action, or park closure.
In such cases, we may offer one or more of the following:
- revised dates;
- reasonable alternative arrangements;
- travel credit; or
- refund of recoverable amounts only.
9. Travel Documents, Health, and Insurance
- You are responsible for valid passport, visa, vaccination, and entry requirements.
- We strongly advise comprehensive travel insurance covering cancellation, curtailment, medical costs, and emergency evacuation.
- If you travel without suitable insurance, resulting losses remain your responsibility.
- Dietary restrictions should be disclosed before booking or as early as possible after booking. Mnyalu Safaris will pass these requests to the relevant supplier, but cannot guarantee availability of special products, imported brands, or personal-preference items at remote properties.
- Unless expressly included in writing, extra food requests, special dietary products, personal brand requests, extra milk, premium snacks, and additional beverages are charged separately where supplied.
10. Flights and Third-Party Suppliers
Airlines, lodges, camps, activity providers, and transport subcontractors apply their own terms and operational policies.
Where their terms are stricter than ours, their terms apply to that component.
11. Liability Limits
To the maximum extent permitted by law:
- our liability is limited to direct loss proven to arise from our breach;
- we are not liable for indirect or consequential loss, including missed onward travel, lost enjoyment, or business loss;
- we are not liable for loss arising from your late arrival, document issues, medical unfitness, or refusal of entry by authorities.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Chargebacks and Payment Disputes
Before initiating a card chargeback, you agree to notify us in writing and allow us 10 business days to review and respond.
Where services were provided in line with confirmed proposal terms, supplier conditions, and these Terms, we may contest chargebacks with booking records, supplier confirmations, communications, and signed acknowledgements.
13. Governing Law and Jurisdiction
These Terms and any booking agreement are governed by the laws of the United Republic of Tanzania.
The parties submit to the competent courts of Tanzania, subject to any mandatory consumer-protection rights that apply in your country of residence and cannot legally be waived.
